Estate Planning
Mangsen Law Estate Planning documents are carefully crafted to preserve the wishes and rights of the client and to avoid unnecessary delays, contentious disagreements among family members and costly litigation.
The individualized Estate Plan is tailored to the client’s goals, needs and circumstances.
A Basic Estate Plan might include the following documents:
- Durable Power of Attorney with Long Term Care Provisions
- Health Care Surrogate and Advance Directives with Guardianship Provisions
- Living Will
- Enhanced Life Estate Deed (Lady Bird)
- A Simple Will
As you will note from this Basic Estate Plan example, Mangsen Law is particularly concerned with what happens to the client while they are still alive and not just what happens after death.
Medicaid Planning
In Florida, The Institutional Care Program (ICP) is a Medicaid program that helps people in nursing facilities pay for the cost of their care plus provides general coverage. ICP eligibility is determined by the Department of Children and Families (DCF).
Pre-Need Planning for Medicaid is most effectively done as soon as Nursing Home Care is considered. Sometimes this is at the time of certain diagnoses. A diagnoses of Alzheimer’s or other type of dementia or a diagnosis of a progressive debilitating physical condition would indicate the immediate need for a consultation with a Medicaid Planning attorney.
Crisis Planning for unexpected illness or accident or lack of pre-need planning also effectively uses asset purchase and transfer strategies to meet Medicaid eligibility requirements.
Florida Medicaid planning is an important part of long term medical care planning.
